Employers and Worker’s Compensation

Policy
EVMS Medical Group may not furnish information from the patient’s medical record to his employer except in the following cases.
- The patient has signed an authorization for the release of information. Refer to Authorization to Use or Disclose Protected Health Information.
- Pursuant to a valid subpoena or court order, or
- As the result of a Worker’s Compensation claim.
In the case of a Worker’s Compensation claim, special care should be exercised in the release of information. Release only information related to the accident, disease or condition for which the employer or insurance company has assumed financial responsibility. AIDS and drug and alcohol abuse information may be disclosed only if a specific release authorizing the release of such information is provided or pursuant to a court order issued after a show cause hearing as set forth in Release of Alcohol and Drug Abuse Treatment Information, and Release of AIDS (Acquired Immune Deficiency Syndrome) Information.
